Tranfer of Insurance must for filing a claim under Motor Insurance

IN Chandigarh a women  who did not get the insurance policy of the car transferred in her name after buying it from the original owner has lost her theft claim. The District Consumer Disputes Redressal Forum has held that the insurance company was right in repudiating her claim after the car was stolen.

 

The complaint in the forum was filed by Suman Sharma, a resident of Sector 21 here. In her complaint, Sharma stated that she purchased the car from Tripta Chopra and got it transferred in her name from the Registering Authority, Chandigarh. The car was comprehensively insured.

In December 2009, the car was stolen from Sector 10, and the complainant registered an FIR. She also reported the theft to the insurance company, but was not given the insurance claim. Later, Sharma came to know from Chopra that she had received some letter from the company.

Sharma got the letter from Chopra, and also got the ‘untraceable report’ from the police in December 2011. When the claim was denied to her, she filed a complaint in the forum.

In its reply, the insurance company told the forum that when the vehicle was stolen, it was insured in the name of Chopra. Hence, Sharma was not entitled to any claim.

The company stated that Sharma did not comply with the provisions of the Indian Motor Tariff Act by getting the insurance policy transferred in her name. Sharma had got the car’s registration transferred in her name, but not the insurance policy.

After considering the case, the forum observed that according to motor tariff rules, the new buyer must apply for fresh certificate of vehicle insurance within 14 days of the purchase of the vehicle. President of the forum P D Goel and members Rajinder Singh Gill and Dr Madanjit Kaur Sahota observed that since this was not done and the car was still insured in the name of the original buyer, the second buyer was not entitled to any insurance claim. In this light, the forum dismissed the complaint.

10 city students selected for IIMs at 3 locations

CHANDIGARH: As many as 10 city-based students have been selected for admission to the Indian Institutes of Management (IIM) at Bangalore, Calcutta and Ahmedabad. The results of these three IIMs were declared on Friday.

The results for the group discussions and interviews for other 10 IIMs are still awaited, and since some of them recently concluded their interviews, the results are expected to be declared by the end of this month.

The IIMs had conducted the written test in January, and more than 150 students from the region were selected.

“This year has seen a significant increase in the number of girls who have got calls from the IIMs and this is bound to reflect in the final results for these institutes,” said Hirdesh Madan, head, North India, at Bulls Eye.
