New India Assurance Company to pay kin of road mishap victim Rs 10.82L compensation

The family of a 44-year-old man, who died in a road mishap involving a rashly-driven truck, hasbeen awarded a compensation of Rs 10.81 lakhs by a Motor Accident Claims Tribunal (MACT) here.

MACT Presiding Officer Anand Swaroop Aggarwal ordered New India Assurance Company Limited, with which the offending vehicle was insured, to pay the sum.

“The New India Assurance Company Limited, being the insurer of the offending vehicle is directed to pay Rs 10,81,924 to the petitioners by way of depositing the same, within 30 days,” the MACT presiding officer said.

The tribunal awarded the compensation on a petition by the widow and children of late Roy Gopal, who worked as a labourer here.

Roy’s nephew, an eye-witness to the mishap, told the MACT that Roy had been mowed down by a rashly-driven truck in August last year at Ram Nagar near Shahdara here.

He sustained grievous injuries and was rushed to a nearby hospital but was declared “brought dead” by the doctors, Roy’s nephew told the tribunal.

Mahesh and Prem Enterprises, the driver and owner of the truck respectively contested the plea saying the accident had taken place due to negligence of the deceased and not due to any fault by them.

The tribunal, however, rejected their arguments after considering the testimony of the eye-witness and other evidence and said that there was gross negligence on the part of Mahesh in driving the offending vehicle.
